Terms & Conditions

1.   Damaged Goods:

The company shall be under no obligation in respect of damaged goods unless the breakage or defect is held for inspection, and the company notified in writing within three days of receipt of goods. In the event of packages arriving damaged the consignment note should be noted accordingly.

2.   Title of Goods:

Title of goods does not pass from seller until all monies are paid.

3.   Price:

Unless otherwise stated the company reserves the right to vary prices quoted to reflect any increases in raw material costs and to also correct any errors. All prices printed exclude delivery and VAT at the prevailing rate.

4.  Terms of Payment:

Cheque with order. Account holders strictly nett 10 days.

5.  Value Added Tax:

The company shall be entitled to charge the amount of value added tax payable whether or not included on the quotation or invoice.

6.   Proofs:

When proofs are submitted for customers approval, no responsibility will be accepted for any errors in proofs passed by him.

7.   Force Majeure:

Every effort will be made to carry out the contract but its due performance is subject to cancellation by the printer or to such variation as he may find necessary as a result of any Act of God, War, Strike, Lockout or other labour dispute, Fire, Flood, Drought, Legislation or other cause (whether of the foregoing class or not) beyond the companies control. No responsibility can be accepted for late deliveries.

8.   Variations in Quantity:

Every endeavour will be made to deliver the required quantity ordered, but quotations are conditional upon a margin of 10 percent being allowed for overs or shortage, the same to be charged for or deducted.

9.   Liability:

The company shall not be liable for indirect or consequential loss or for any loss to the customer arising from third party claims occasioned by errors in carrying out the work or by delay in delivery.

10.   Expedited Delivery:

Should expedited delivery be agreed and necessitate overtime or other additional cost, an additional charge may be made. All deliveries are chargeable.

11.   Copyright:

No warranty that the goods sold do not infringe the copyright of a third party is given or is to be implied. If they are manufactured to the purchasers design or according to the purchasers instruction, the purchaser shall indemnify the seller in respect of all claims, damages, costs and expenses in respect of any alleged infringement and on discovery of such infringement the seller shall be at liberty to terminate the contract and receive payment for all goods supplied, made up or allocated to the purchaser even if not yet at the agreed place of collection by the purchaser or if it shall have been so agreed, not yet delivered by the seller.

12.   Artwork:

All prices assume that camera ready, same size, artwork is supplied, colour separated if more than one colour.

13.   Product Liability - Public Liability:

Portfolio Display Ltd. cannot be held liable for damage or injury caused by storms, wind, rain, sun or misuse. The responsibility for use is strictly with the end user/customer.

For the avoidance of doubt nothing in this agreement shall confer on any third party any benefit or the right to enforce any term of this agreement.
